TERMS AND CONDITIONS FOR AUDIO CONVERSION SERVICES

Bonafide Data Rescue LLC (here forth known as BDR in this document) will convert client media files into digital formats to help create backup copies and for their sole personal convenience. The media provided to BDR by the client should only be material that you are authorized or legally permitted to change in format. Any further duplication, sharing or distribution of these converted files should be done only within the terms of current ‘fair use’ copyright laws. You agree to hold BDR harmless from any violation of copyright laws by your use of the service.

BDR is not responsible for replacing CD’s or other media that has been lost or damaged by the shipper. It is the customer’s responsibility to purchase adequate insurance to cover such possible scenarios and to seek financial remedy from the shipper. The customer is responsible for declaring correct market values for insurance purposes.

BDR will provide tagging of the digital media whenever possible, but is not responsible for the content of the online CD databases used for ID tagging.

BDR will make our best efforts to read and convert all media that is sent to us. However, our ability to successfully convert these audio files to digital will depend upon the condition of the media provided to us. There will be no charge to our customers for discs that prove to be unreadable. Media containing copy protected material will not be converted.

BDR is not liable for any damages to any additional equipment owned by the client, including but not limited to computers, hard drives and digital audio players.

BDR will not issue refunds or credits due to any delays in processing, incorrect shipments or other errors or omissions resulting from the client’s acts. We will reserve the right to issue refunds or credits based on our assessment of any service failures that occur during the processing of your collection.

You agree to indemnify, defend and hold BDR harmless from and against any and all claims, damages, losses, costs, and expenses that arise directly or indirectly from (a) your breach of any provision of these Terms and Conditions of Service; (b) any allegation that any materials you provide constitute any manner of copyright infringement.

BDR will retain a backup copy of each customer’s library for 60 days after it has been shipped. This should allow ample time for our customers to create a backup and review the quality of the converted media.

All payments for orders are due prior to final delivery.
